Probate is the legal process where a court oversees how a person\u2019s assets are gathered, debts are paid, and property is distributed to heirs or beneficiaries.<\/span><\/p>\n<p><span data-preserver-spaces=\"true\">If there is a <\/span><strong><span data-preserver-spaces=\"true\">will<\/span><\/strong><span data-preserver-spaces=\"true\">, the court first checks that it is valid under Florida law. Suppose there is <\/span><strong><span data-preserver-spaces=\"true\">no will<\/span><\/strong><span data-preserver-spaces=\"true\"> (known as dying <\/span><em><span data-preserver-spaces=\"true\">intestate<\/span><\/em><span data-preserver-spaces=\"true\">). In that case, the court determines how to distribute the assets and appoints the personal representative of the estate.<\/span><\/p>\n<p><span data-preserver-spaces=\"true\">The personal representative (also called an <\/span><strong><span data-preserver-spaces=\"true\">executor<\/span><\/strong><span data-preserver-spaces=\"true\">) has several key responsibilities:<\/span><\/p>\n<ul>\n<li><span data-preserver-spaces=\"true\">Gathering and documenting all estate assets (real estate, vehicles, bank accounts, investments, jewelry, etc.).<\/span><\/li>\n<li><span data-preserver-spaces=\"true\">Notifying creditors and paying valid debts, including medical bills and funeral costs.<\/span><\/li>\n<li><span data-preserver-spaces=\"true\">Distributing remaining assets to heirs and beneficiaries.<\/span><\/li>\n<li><span data-preserver-spaces=\"true\">Closing the estate once everything is settled.<\/span><\/li>\n<\/ul>\n<p><span data-preserver-spaces=\"true\">But did you know there are <\/span><strong><span data-preserver-spaces=\"true\">different types of probate in Florida<\/span><\/strong><span data-preserver-spaces=\"true\">? Let\u2019s break them down.<\/span><\/p>\n<h2 data-start=\"1393\" data-end=\"1436\">Formal Administration (Formal Probate)<\/h2>\n<p><strong><span data-preserver-spaces=\"true\">Formal administration<\/span><\/strong><span data-preserver-spaces=\"true\"> is the most common type of probate in Florida. It takes place in the County Circuit Court where the person lived at the time of death.<\/span><\/p>\n<p><span data-preserver-spaces=\"true\">A judge appoints a personal representative to manage the estate. Because the process can be complex and time-consuming, most personal representatives work with an experienced <\/span><strong><span data-preserver-spaces=\"true\">Florida probate lawyer<\/span><\/strong><span data-preserver-spaces=\"true\"> to ensure everything is handled correctly.<\/span><\/p>\n<h2 data-start=\"1855\" data-end=\"1882\">Summary Administration<\/h2>\n<p><strong><span data-preserver-spaces=\"true\">Summary administration<\/span><\/strong><span data-preserver-spaces=\"true\"> is a simplified process for smaller estates. It can be used if:<\/span><\/p>\n<ul data-start=\"1977\" data-end=\"2086\">\n<li data-start=\"1977\" data-end=\"2030\">\n<p data-start=\"1979\" data-end=\"2030\">The total estate value is <strong data-start=\"2005\" data-end=\"2024\">$75,000 or less<\/strong>, or<\/p>\n<\/li>\n<li data-start=\"2031\" data-end=\"2086\">\n<p data-start=\"2033\" data-end=\"2086\">The person passed away more than <strong data-start=\"2066\" data-end=\"2083\">two years ago<\/strong>.<\/p>\n<\/li>\n<\/ul>\n<p><span data-preserver-spaces=\"true\">This process is generally faster and less expensive than formal probate. Instead of a complete court-supervised administration, the court reviews a petition that lists the assets and explains how they will be distributed. If approved, the assets will be transferred directly to the beneficiaries.<\/span><\/p>\n<h2><span data-preserver-spaces=\"true\">Disposition Without Administration<\/span><\/h2>\n<p><span data-preserver-spaces=\"true\">This is the least standard option and is only available for tiny<\/span><strong><span data-preserver-spaces=\"true\"> estates<\/span><\/strong><span data-preserver-spaces=\"true\">.
